GOP Lawmakers Ask Implore Roberts to Address Anonymous Judges Criticizing SCOTUS

Two senior Republican lawmakers asked John G. Roberts Jr. to review anonymous comments made by federal judges criticizing the Supreme Court’s handling of cases involving Donald Trump. The request came in a letter sent on November 5, 2025, by Chuck Grassley, chairman of the United States Senate Judiciary Committee, and Jim Jordan, chairman of the United States House Judiciary Committee.

The lawmakers argued that the remarks—reported by major news outlets—may violate judicial ethics rules. Some judges described the relationship between lower courts and the Supreme Court as a “war zone,” while others suggested the high court’s emergency rulings were helping the Trump administration bypass lower court decisions. Grassley and Jordan warned that such statements, even if anonymous, could damage public confidence in the judiciary.

The criticism stems largely from the Supreme Court’s increased use of its emergency or “shadow docket.” These fast-track rulings allow the court to decide urgent matters without full arguments or lengthy written opinions. Several lower court judges expressed frustration because many of these decisions favored the Trump administration and often lacked detailed explanations.

In their letter, the lawmakers said the comments might conflict with the judicial code of conduct, which requires judges to maintain impartiality and avoid public discussion of ongoing cases. They asked Roberts, who also leads the federal judiciary’s administrative body, to determine whether any ethics review or guidance is needed.

The dispute reflects growing tension within the federal court system over transparency, judicial norms, and the expanding role of emergency Supreme Court decisions.
